Medical Data Debate – Modern Healthcare-June 29th, 2015

The Supreme Court today decided that next term (starting October 2015) it will hear Gobeille v. Liberty Mutual Insurance Co. This case out of Vermont essentially has to do with the release of medical records to the State from the insurance company’s third party administrator. ERISA which regulates traditional pensions and other employer-provided benefits according to Liberty protects the carrier or its administrator from releasing such records.

The State’s position is that it needs healthcare data in order to improve healthcare performance and to help with providing the best possible care available.
